panel not corralling maximized windows

I've asked this on general Ubuntu questions, so instead of a bug report I'll ask here
xfce4 panel not corralling maximized windows
panel is staying on top of a maximized windows, causing loss of some window area.
Unable to find any on top setting for panel setting.
Panel is Panel 0 and has been moved long ago from top of screen to bottom.
Moving panel back to top of screen covers title bar and controls of windows.

[x] increase length

video driver: nvidia 304
