Ubuntu 10.04.03LTS rsyslog stopped by lightweight

Feb 13 06:33:28 srswput01 rsyslogd: [origin software="rsyslogd" swVersion="4.2.0" x-pid="615" x-info="http://www.rsyslog.com"] rsyslogd was HUPed, type 'lightweight'.

All services have stopped including ssh. This host is a VM on Hyper-V
 rsyslog 4.2.0-2ubuntu8.1
DISTRIB_ID=Ubuntu
DISTRIB_RELEASE=10.04
DISTRIB_CODENAME=lucid
DISTRIB_DESCRIPTION="Ubuntu 10.04.3 LTS"

2.6.32-37-server x86_64

Actions taken:
stopped the rsyslog daemon, then started the rsyslog daemon. Logging began after this set of actions.

I see that this issue has persisted in Ubuntu for several releases. Is there a fix for Ubuntu 10.04.xx LTS?
