windows hiding under Indicators bar at top of screen

Hi just a small problem when I open a window unless it is full size, the Window Buttons are hidden under the top bar, I can use the Application Menus but if I want to use the windows buttons I have to grab the window (Alt+mouse clip and hold) each time and move in down to to use them.
any ideas how to fix

If this concerns the Ubuntu 12.04 then:

this is not a problem , this is a function . Named Global menu , I think .

Try to move your mouse in the left side of up bar. I assume you will see the buttons there.

No matter if you have changed the button´s side from left to right , when global menu arrives (fullscreen) then the buttons placed at left in top bar.

but this is not normal.
to illustrate,
if I open a PDF it will open as a small window not full screen which is fine. but the red X to close the window is under the top bar I can see the Application Menus. and click on file and then close. but if I want to use the Window Buttons, they are under the launcher so I have to grab the window move it to reduce it or close it etc.

Sorry but I don't understand from the description what exactly the problem is. (maybe is fault of my English)

Can you upload a screenshot to a host (eg : Imageshack) , and give here the link ?

Also give little more info . Open a terminal (Ctrl+alt+t) and copy-paste from here bellow commands , one at time.

1. cat /etc/lsb-release && uname -r

2. env | grep DESK

post the results back here.

Okay info as requested is above.. the link is to drop box.
you will see 2 screen shoots almost the same. but the second one has the mouse over the bar showing the Application Menus but in both pictures there is no red X etc.
if I move the window down there they are so it is hiding under.

This seems like a problem with docky you are use.

Did you try without docky ?

A workaround of this problem might be the bellow command in terminal ..

1) gconftool-2 --set -t string /apps/metacity/general/button_layout :minimize,maximize,close
