Chromium scrolling leads to tab scrolling

hi folks

ubuntu 14.04 mactel
Apple Macbook Pro 3.1
Microsoft Microsoft IntelliMouse® Explorer

FF is working fine but

Chromium shows the following bug/error:

i have about 20 open tabs. sometimes when i scroll with the scroll wheel chromium doesent scroll the current tab up/down. instead it starts scrolling tabs without pushing any keys at that time!

imho this is a bug.

What is the output of:

lsb_release -a; uname -a; apt-cache policy chromium-browser

If your mouse cursor goes over the tab area of the browser then it will scroll them. This is normal behaviour

to be clear the mouse cursor never goes near the tab bar while this happes. mostly its in the center area of the page i'm browsing. i know the feature to change tabs while scrolling over the tab bar, but this ist NOT what im reporting here.
