Won't you consider dual installing from the CD? It seems more problems uccur in Ubuntu when installed from within Windows via WUBI.
See instructions here:

is there a way to dual install with out a Linux kernel rewriting my MBR?

It should rewrite it in the way to make dual install. Otherwise if not rewrited you'll have only the Windows when booting.
You can install dual booting if you have enough free disk space - about 9 MB for Ubuntu to feel normal.
It is good explained in Ubuntu's site as for beginners.

in the link u sent me click on #5 read that in the linux part, the last 2 lines of that section, it says it "dd is also a commonly used Linux command to copy or overwrite any sector, MBR included." how do i keep it from overwrite the MBR?. you how when u install insde windows all it does to the MBR is add it into the windows boot record for dual booting. how do i par-say dual boot ubuntu and windows 7 and maintain windows 7 as my primary partition and keep my current boot record code?

Well, You want Windows and Ubuntu together at the boot, am I right or not?
If not - what do you ask and what do You want? It's not clear for me.

Let me help. What Michael is asking is if there is a way to control the was Ubuntu edits the MBR. When you install in windows, the MBR shows windows as the primary OS and ubuntu as an alternative. But when you do a full install, the MBR is edited so that u first have linux options, and windows pushed down to the very bottom of the list. It's kind of like Linux has taken over your hard drive after you install, and windows is some kind of dependant to LINUX, It really looks like Linux came first, and windows was installed later. Personally, I don't like that very much and would like it to be changed.

There is a software named "Startup Manager" . by using this soft you can
change the boot sequence and there are some other options to change the boot
loader. you can find it from Synaptic Package Manager or Add/Remove

I suggest you to install Ubuntu NOT using Wubi.

If you have installed Ubuntu via Wubi please uninstall it read
http://wubi-installer.org/faq.php and https://wiki.ubuntu.com/WubiGuide

Installing Ubuntu using Wubi make Ubuntu less robust and all problems that you will have to Windows can be affect your Ubuntu partition file.

I strongly suggest you to install Ubuntu+Windows in dual mode creating a real Ubuntu ext3 or ext4 partition.
In this mode you can use Ubuntu and Windows ad usual and then using installed Ubuntu you can save or repair damaged (due viruses or other issue) Windows partitions data.

- Here the steps to install Ubuntu 9.04 https://help.ubuntu.com/community/GraphicalInstall there is also at top of that page a video that show the installing process

Is very easy to install, if you need info please ask.

Thank you
