Device doesn't close when program abends, won't open when program restarts. How do I close it?

I created a device in /dev. I used insmod to install the .ko file. I execute the program the first time and 'open' returns a file handle. When the program crashes and is restarted, 'open' returns a 16, EBUSY, Device or resource busy.
How can I close the device and reopen it, or maybe get a handle to it since it is already open?
