Installation without formating root partition

Why the installation cannot continue without formating root partition? I don't want to lose some data and don't have other space to store them. With my basic knowlage of python, I removed detection and error popup, removed .pyc files, restarted instalation process while running from instalation media. But it still do the same. Ubiquite won't let me pass to the next step.
I also don't see any objective reason, to refuse continue in instalation process because of unformated '/'.
