How is Sparkle affected by the Apple Patent 5764992 on auto-updates?

Apple recently had granted this patent http://www.google.com/patents?vid=USPAT5764992 on automatic updates. Depending on exactly how Sparkle works, does it infringe the patent and, if so, can we fix it to avoid infringement?

Of course, IANAL, but the claims seem to apply to a much more powerful update system than what Sparkle does: in-memory updates, and background processes. I don't think any of the claims are actually doing what Sparkle does.

I think I'll just worry about this if Apple ever complains. Hopefully that's reasonable…
