The live CD contains the Oneiric release kernel, which is version 3.0.0-12.20 as indicated at https://launchpad.net/ubuntu/+source/linux (expand The Oneiric Ocelot). This fulfills kernel-request-3.0.0-12.20 (https://bugs.launchpad.net/ubuntu/+source/linux/+bug/765438/comments/27), so I'm marking this bug back to Confirmed.

Yes, as reported by cgonzalez (https://bugs.launchpad.net/ubuntu/+source/linux/+bug/765438/comments/28 & https://bugs.launchpad.net/ubuntu/+source/linux/+bug/765438/comments/29), this bug still occurs with the latest kernel in Oneiric.
